1. About these Terms

These Terms of Service (the “Terms”) govern your access to and use of https://soccerfreshpro.com (the “Site”) and any purchase of products sold under the SoccerFresh name through the Site.

The Site and products are operated and sold by:

In these Terms, “SoccerFresh,” “we,” “us,” and “our” mean the seller identified above. “You” and “your” mean the person accessing the Site or placing an order.

By placing an order, you confirm that you have read and accepted these Terms. If you do not agree to them, do not place an order or use the Site.

These Terms apply together with our Privacy Policy, Refund Policy, and Shipping Policy. If there is a conflict concerning returns, refunds, or delivery, the policy dealing specifically with that subject will apply, except where these Terms or mandatory law provide greater rights.

Nothing in these Terms excludes, restricts, or replaces any consumer right or remedy that cannot lawfully be excluded or restricted.

2. Eligibility and consumer purchases

You must be at least 18 years old, or the age of legal majority where you live, to place an order. If you place an order for a business or another organisation, you confirm that you have authority to bind it.

Statutory consumer rights, including cooling-off rights, apply only where you purchase mainly for personal, family, or household use and qualify as a consumer under the applicable law.

3. Products and product information

We take reasonable care to describe and display products accurately. Colours, packaging, labels, plug types, and minor product details may look different depending on your screen, production batch, or market, provided the product remains materially consistent with its description and applicable law.

Product images are illustrative. The description on the product page at the time of your order forms part of the contract. If a material error affects a product description, specification, price, or availability, we may correct the error and contact you before dispatch to confirm whether you wish to proceed. You may cancel for a full refund if you do not wish to proceed.

We may limit product quantities per person, household, order, payment method, or address where reasonably necessary to prevent fraud, misuse, or unauthorised resale.

4. Prices, taxes, and charges

Prices are shown in the currency selected for your market. Where required by applicable law, displayed consumer prices include applicable VAT, GST, or other sales taxes. In markets where tax is normally calculated separately, including certain US jurisdictions, applicable tax may be added at checkout.

Delivery charges and any other mandatory charges will be shown before you submit your order. You will not be responsible for import duties or similar charges unless this is clearly disclosed before checkout. Your bank or payment provider may charge currency-conversion or international-transaction fees, which we do not control.

We may change prices and promotions at any time, but changes will not affect an order we have already accepted. Promotional offers are subject to the terms displayed with the offer and may not be combined unless expressly stated.

5. Orders and formation of the contract

Your order is an offer to buy the products in your cart. After you place an order, we will send an acknowledgement confirming that we received it. This acknowledgement does not by itself mean that we have accepted the order.

A binding sales contract is formed when we send you a dispatch confirmation or otherwise expressly accept the order. If we cannot accept your order, we will notify you and refund any amount charged. Reasons may include lack of stock, a material pricing or description error, payment failure, suspected fraud, delivery restrictions, or a legal or regulatory restriction.

Please review your order and contact us promptly if any information is incorrect. We cannot guarantee that an order can be changed or cancelled after processing begins, but your statutory cancellation rights remain unaffected.

6. Payment

Available payment methods are displayed at checkout. You confirm that you are authorised to use the payment method provided and that the billing information is accurate.

Payments may be processed by third-party payment providers. Their separate terms may apply to their services. We may perform or request reasonable fraud-prevention and identity checks before accepting or dispatching an order.

7. Shipping and delivery

Available delivery destinations, methods, estimated times, and charges are described at checkout or in our Shipping Policy. Delivery dates are estimates unless we expressly agree to a guaranteed date.

Products may be dispatched from fulfilment facilities in different countries, including facilities in Europe, the United Kingdom, or China, depending on inventory and destination. This does not reduce your rights against us as the seller.

You must provide a complete and accurate delivery address. If delivery fails because the address was incorrect or incomplete, or because you did not reasonably cooperate with delivery, we may charge reasonable additional delivery costs where permitted by law.

If we cannot ship within a promised period, we will notify you and provide any cancellation or refund option required by applicable law. For US orders, if no shipping time is stated, we will ship within the period required by applicable US law or obtain your consent to a delay and offer the required refund option.

Risk of loss or damage passes to a consumer when the consumer, or a person nominated by the consumer other than the carrier, physically receives the goods, except where applicable law provides otherwise. Ownership passes when we receive payment in full or, if later, when the goods are delivered.

8. Cancellations, returns, refunds, and the 90-Day Risk-Free Trial

Our voluntary 90-Day Risk-Free Trial is additional to, and does not replace or limit, your statutory rights. Its eligibility rules, return process, and refund conditions are set out in our Refund Policy. If a promotional statement conflicts with the Refund Policy, the statement giving the customer the greater right will apply.

Ireland and other EU/EEA consumers

If you are a consumer in Ireland or another EU/EEA country, you generally have the right to withdraw from an online purchase without giving a reason within 14 days after you, or a person nominated by you other than the carrier, receives the goods. You must notify us within that period and return the goods within the following 14 days, subject to applicable exceptions.

We will refund the purchase price and the cost of our least expensive standard delivery option, using the original payment method, within the period required by law. We may withhold the refund until we receive the goods or you provide evidence that you sent them back, whichever occurs first. You are responsible for the direct return cost unless we agreed otherwise or failed to provide legally required information. We may deduct an amount for diminished value caused by handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

United Kingdom consumers

If you are a UK consumer, you generally have the right to cancel an online order without giving a reason within 14 days after delivery and a further 14 days to return the goods, subject to applicable exceptions. Refund timing, standard-delivery reimbursement, return costs, and permitted deductions for diminished value will be handled in accordance with UK law and our Refund Policy.

Australian consumers

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a repair, replacement, refund, compensation, or another remedy if those guarantees are not met. Our voluntary change-of-mind or trial policy does not restrict these rights.

United States consumers

Returns for change of mind are governed by our Refund Policy and any applicable state law. Nothing in these Terms limits a right or remedy that cannot lawfully be waived under applicable federal or state law.

For all markets, a refusal of a voluntary return does not affect rights relating to faulty, damaged, unsafe, misdescribed, or non-conforming goods.

9. Faulty, damaged, or non-conforming products

Please inspect your order after delivery and contact us promptly if an item is damaged, faulty, unsafe, incorrect, or not as described. Include your order number and, where reasonably requested, photographs or other information that helps us assess the issue.

Depending on applicable law and the circumstances, remedies may include repair, replacement, price reduction, rejection, refund, or compensation. We will cover reasonable return costs where required by law. Any commercial warranty we offer is in addition to statutory consumer guarantees and remedies.

10. Safe and intended use

You must use each product only for its intended purpose and in accordance with the supplied instructions, warnings, electrical rating, plug type, and safety information. Do not use a product if it appears damaged, has been exposed to water contrary to its instructions, or is incompatible with your local power supply.

Our products are not medical devices and are not intended to diagnose, treat, cure, or prevent disease. Product statements about freshness, odour, moisture, or hygiene describe intended product functions and do not promise medical outcomes.

Nothing in this section limits liability for a defective or unsafe product where that liability cannot lawfully be excluded.

11. Accounts and customer information

If the Site allows customer accounts, you are responsible for keeping your login information confidential and for activity under your account. Tell us promptly if you suspect unauthorised access. You must provide current, complete, and accurate order and account information.

We may suspend or close an account where reasonably necessary to protect the Site, customers, or our legal rights, including in cases of fraud, abuse, security risk, or material breach of these Terms.

12. Intellectual property

The Site and its content, including the SoccerFresh name, logos, product names, graphics, photographs, videos, text, designs, and software, are owned by us or used under licence and are protected by intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Site for personal shopping and other lawful, non-commercial purposes. You may not copy, reproduce, distribute, modify, sell, scrape, reverse engineer, or commercially exploit Site content except with our prior written permission or where the law expressly permits it.

13. Reviews, comments, and other submissions

If you submit a review, photograph, comment, suggestion, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, and does not infringe another person’s rights.

You retain ownership of your content. You grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt, publish, translate, and display it for operating, improving, and promoting SoccerFresh, subject to applicable privacy and advertising laws. This licence ends if the content is deleted from our systems, except to the extent it has already been used lawfully or must be retained by law.

We may moderate or remove unlawful, misleading, abusive, infringing, irrelevant, or fraudulent content. We do not promise to publish every submission. We will not present reviews in a misleading manner or suppress genuine negative reviews merely because they are negative.

14. Prohibited use

You may not use the Site:

  • for unlawful, fraudulent, abusive, or misleading purposes;

  • to infringe intellectual-property, privacy, publicity, or other rights;

  • to transmit malware or interfere with the Site’s security or operation;

  • to collect information about others without lawful authority;

  • to place fraudulent orders, misuse promotions, or evade purchase limits;

  • to impersonate another person or misrepresent your identity; or

  • to resell Site access or use automated means to extract Site content without permission, except where such restriction is prohibited by law.

We may take reasonable protective action, including restricting access or cancelling fraudulent orders, while respecting rights that cannot lawfully be excluded.

15. Third-party services and links

The Site may use or link to third-party services, including Shopify, payment processors, delivery providers, analytics services, and social-media platforms. We are responsible for our obligations as the seller, but we do not control independent third-party sites or services. Your use of those services may be governed by their own terms and privacy notices.

A link does not imply endorsement. We are not responsible for independent third-party content or conduct, except where applicable law makes us responsible.

16. Privacy

Our collection and use of personal information are described in our Privacy Policy. By submitting personal information through the Site, you acknowledge that it will be processed as described there and as permitted by applicable data-protection law.

17. Availability, errors, and changes

We do not guarantee that the Site will always be uninterrupted, secure, or error-free. We may maintain, change, suspend, or discontinue Site features where reasonably necessary. This does not affect orders already accepted or rights and remedies relating to them.

We may correct typographical, technical, pricing, availability, or other errors. If a correction materially affects an order already placed, we will notify you and provide any cancellation or refund right required by law.

18. Disclaimers

To the fullest extent permitted by law, the Site is provided on an “as available” basis. We do not give warranties about the Site or products other than those expressly stated by us or imposed by law.

We do not exclude or restrict implied terms, statutory guarantees, or warranties that cannot lawfully be excluded or restricted, including consumer guarantees concerning quality, fitness for purpose, conformity, description, title, and safety.

19. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, deliberate misconduct, defective products where liability is mandatory, or breach of non-excludable consumer rights.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for loss that was not reasonably foreseeable when the contract was formed, or for business loss arising from a consumer purchase.

If you purchase wholly or mainly for business purposes, then, to the fullest extent permitted by law, we will not be liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, goodwill, or data. Our aggregate liability relating to a business order will not exceed the amount paid for that order, except where liability cannot lawfully be limited.

20. Indemnity for business misuse

If you use the Site or purchase products wholly or mainly for business purposes, you agree, to the extent permitted by law, to compensate us for reasonable losses, liabilities, and costs resulting directly from your unlawful misuse of the Site, infringement of another person’s rights, or material breach of these Terms.

This section does not apply to consumers to the extent its application would be unfair or unlawful.

21. Events outside reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, such as natural disasters, war, civil disruption, labour disputes, transport interruption, carrier failure, governmental action, epidemics, utility failure, or major network disruption.

We will take reasonable steps to minimise the effect and will inform you where an accepted order is materially affected. This section does not remove any right to cancel or obtain a refund that applicable law gives you.

22. Suspension and termination

You may stop using the Site at any time. We may suspend or terminate access for a material breach of these Terms, unlawful conduct, fraud, abuse, or a security threat. Provisions that by their nature should continue after termination—including payment obligations, intellectual-property rights, liability provisions, and dispute terms—will survive.

Termination of Site access does not affect an existing sales contract or either party’s accrued rights unless the order is separately cancelled in accordance with these Terms and applicable law.

23. Governing law and disputes

These Terms and any non-contractual obligations arising from them are governed by the laws of Slovenia, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections granted by the law of the country where you habitually reside.

The courts of Slovenia will have jurisdiction, but if you are a consumer, you may also bring proceedings in any court available to you under mandatory applicable law. Nothing in these Terms requires a consumer to waive a right to use a competent local court or public consumer-protection authority.

Unless required by applicable law, we do not undertake to participate in proceedings before an out-of-court consumer dispute-resolution provider. This does not prevent us from agreeing to mediation or another resolution process for a particular dispute.

24. Changes to these Terms

We may update these Terms to reflect legal, operational, or service changes. The version published when you place an order governs that order unless a change is required by law or you agree otherwise. We will publish the updated Terms and revise the “Last updated” date.

25. General provisions

If any provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent, except where the law permits. We may transfer our rights and obligations as part of a business reorganisation or transfer, provided this does not reduce your consumer rights.

These Terms, together with the policies expressly incorporated into them and the order information confirmed to you, form the agreement between you and us concerning the relevant purchase.
